These Terms of Service ("Terms") govern your access to and use of kort.digital (the "Site") and the digital business card platform, hosted profiles, and NFC hardware products (together, the "Services") provided by eeclipse technologies OÜ, a company registered in Tallinn, Estonia ("kort", "we", "us", or "our"). By creating an account, purchasing an NFC card, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
You must be at least 16 years old to create a kort account. When you register, you agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account, and you agree to notify us promptly of any unauthorized use.
kort provides a platform for creating and sharing digital business card profiles, together with optional NFC hardware cards that link to those profiles. The features available to you depend on the plan you select, as described on our Pricing and Business Pricing pages. We may add, change, or remove features from the Services at any time.
Certain features require a paid subscription, billed monthly or annually as selected at checkout. Subscriptions renew automatically unless cancelled before the next billing date. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Except where required by applicable law, we do not provide refunds for partial billing periods or unused time.
Physical NFC cards are sold separately from, or bundled with, a subscription plan as described at checkout. Order confirmation, estimated delivery times, and shipping costs are shown at the time of purchase. Risk of loss passes to you upon delivery to the shipping address you provide. If a card arrives damaged, defective, or is not as described, contact us within 14 days of delivery and we will arrange a replacement or refund.
When using the Services, you agree not to:
– use the Services for any unlawful, fraudulent, or harassing purpose;
– attempt to gain unauthorized access to our systems, another user's account, or any non-public part of the Services;
– upload content that infringes the intellectual property or other rights of a third party, or that violates applicable law;
– interfere with, disrupt, or place an undue burden on the Services or the networks connected to them; or
– use automated means to scrape, harvest, or collect data from the Services without our prior written consent.
We may suspend or terminate accounts that violate this section.
You retain ownership of the profile content, images, and information you submit to kort ("Your Content"). By submitting Your Content, you grant us a limited, worldwide, royalty-free license to host, store, and display it solely for the purpose of operating and providing the Services to you. Where a visitor to your profile submits their own contact details to you ("Lead Data"), you act as the data controller of that Lead Data, and we process it on your behalf as described in our Privacy Policy.
The kort name, logo, and the design, software, and content of the Site (excluding Your Content) are owned by eeclipse technologies OÜ or our licensors and are protected by copyright, trademark, and other applicable laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose. No other rights are granted, and you may not copy, modify, or create derivative works from the Services except as permitted by these Terms.
The Services may link to or integrate with third-party platforms, including Apple Wallet and Google Wallet. We are not responsible for the availability, content, or practices of these third-party services, and your use of them is governed by their own terms and privacy policies.
The Services are provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or entirely secure.
To the extent permitted by applicable law, eeclipse technologies OÜ will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim arising from these Terms or the Services will not exceed the amount you paid us in the twelve (12) months preceding the claim. Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for gross negligence, willful misconduct, or death or personal injury caused by our negligence.
We may suspend or terminate your access to the Services if you breach these Terms, or with reasonable notice where no breach has occurred. You may stop using the Services and delete your account at any time. Sections that by their nature should survive termination, including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law and Disputes, will continue to apply after termination.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Site before the changes take effect. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Estonia, without regard to its conflict of law principles. Any dispute arising from these Terms or the Services will be subject to the exclusive jurisdiction of the courts of Estonia, except where mandatory consumer-protection law in your country of residence provides otherwise.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
